Fireflies Educational Enrichment Center
These Terms & Conditions (“Terms”) govern your access to and use of the Fireflies website and any programs, services, sessions, communications, materials, and content provided by Fireflies Educational Enrichment Center (“Fireflies,” “we,” “our,” or “us”). By accessing our website, creating an account, enrolling, purchasing, or participating in any Fireflies service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Services
Fireflies provides educational enrichment programs that support language development (English/Spanish) and emotional education, designed to strengthen emotional literacy, empathy, self-awareness, communication, social skills, and related learning skills in students.
Nature of Services (Educational / Non-Clinical): Fireflies services are provided as a proceso confidencial educativo-emocional. Fireflies services are educational and psychopedagogical in nature and do not constitute medical, psychological, psychiatric, or therapeutic care. Fireflies does not diagnose, treat, or provide clinical mental health services, and Fireflies services do not replace professional health or mental health evaluation or treatment. Families are responsible for seeking licensed professional services when needed.
2. Registration and Access
To access certain programs or features, you may need to create an account and/or complete registration forms. You are responsible for providing accurate, current, and complete information and for updating your information when necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Fireflies will not be responsible for any loss or damage arising from your failure to maintain account security or from unauthorized use outside Fireflies’ reasonable control. You agree to notify Fireflies immediately of any unauthorized access or security breach.
3. Use of Services
Fireflies services are provided solely for educational purposes and for personal/family use by enrolled participants. You agree not to use our website, programs, or materials for any illegal or unauthorized purpose.
You agree not to reproduce, duplicate, copy, sell, resell, exploit, publicly share, or commercially use any portion of our services or content without Fireflies’ express written permission.
No Unauthorized Recording: For privacy and confidentiality, families and participants may not record sessions, staff, or other participants without Fireflies’ prior written authorization.
4. Intellectual Property
All programs, methodologies, structures, curriculum, session content, worksheets, reports, exercises, communications, videos, designs, branding, and materials developed or provided by Fireflies are protected by intellectual property laws and remain the exclusive property of Fireflies (or its licensors).
You may not reproduce, distribute, modify, publish, transmit, translate, create derivative works from, or disseminate Fireflies materials—whether in whole or in part—without prior written authorization from Fireflies.
5. User Responsibility
You are responsible for your conduct and for any activity that occurs under your account, including compliance with these Terms and any program-specific guidelines communicated by Fireflies. You agree to communicate respectfully with Fireflies staff and to follow safety and operational policies.
You must immediately notify Fireflies of unauthorized use of your account or any other breach of security. Fireflies will not be liable for any loss or damage resulting from unauthorized use outside of Fireflies’ reasonable control.
6. Payments, Billing, and Cancellation
6.1 Monthly Billing and Automatic Charges
Payments for programs billed monthly are made on a monthly basis and may be charged automatically to the payment method on file. You authorize Fireflies to charge your selected payment method according to the billing schedule for the program you enroll in. You are responsible for maintaining a valid payment method and ensuring successful payment processing.
6.2 Cancellation of Monthly Enrollment (30-Day Notice)
If you wish to cancel a monthly program or membership, you must notify Fireflies at least one month (30 days) in advance.

Once your notification is received, Fireflies will guide you through the appropriate cancellation process and confirm the effective end date. No refunds will be issued for payments already made.
6.3 Session Cancellation, No-Shows, and Make-Up Sessions (24-Hour Policy)
Sessions are considered delivered and non-refundable if the cancellation is not communicated at least 24 hours in advance.
If notice is provided at least 24 hours in advance, the family may request a make-up session, subject to availability. Make-up sessions are not guaranteed and depend on scheduling capacity and program structure.
No refunds will be issued for missed sessions without proper notice.
6.4 Weather Disruptions and Holidays
In the event of extreme weather disruptions or holidays, sessions may be rescheduled without penalties, subject to availability.
7. Modification of Services and Terms
Fireflies reserves the right to modify, suspend, or discontinue any aspect of its services at any time, with or without prior notice. While we strive to maintain quality and continuity, we do not guarantee that programs will always be available at all times or in all formats.
Fireflies may update these Terms at any time. If changes are significant, Fireflies will provide notice through the website or direct communication when reasonably possible. Continued use of services after changes become effective constitutes acceptance of the updated Terms.
8. Limitation of Liability
To the fullest extent permitted by law, Fireflies will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of, participation in, or inability to use our services, including but not limited to damages for loss of profits, use, data, or other intangible losses.
9. Data Protection and Privacy
Fireflies respects your privacy and is committed to protecting personal data. Please review our Privacy Policy for information on how we collect, use, store, and protect your data. By using our services, you agree to the collection and use of information in accordance with our Privacy Policy.
Confidentiality: All information shared during sessions, as well as written reports, materials, exercises, communications, and content provided, is considered confidential and is used solely within the scope of the Fireflies proceso confidencial educativo-emocional, except where disclosure is required by law or necessary to protect safety.
Session Documentation (Audio/Video Recording for Educational Reports): To support quality, continuity, and the creation of internal educational documentation and reports for families, Fireflies may occasionally record portions of a session (audio and/or video). Any such recording is treated as confidential within the Fireflies proceso confidencial educativo-emocional, used solely for internal educational purposes and family reporting, and is not shared publicly or with third parties without written consent, except as required by law. Families may request limitations on recording in writing, and Fireflies will make reasonable efforts to accommodate such requests when compatible with program requirements.
10. Third-Party Links
Our website, services, or communications may contain links to third-party websites. These links are provided solely for your convenience and do not imply any endorsement. Fireflies is not responsible for the content, policies, services, or privacy practices of third-party sites.
11. Consent to Participate (Minors)
As the parent or legal guardian of the student(s), you consent to their participation in the bilingual emotional education tutoring programs offered by Fireflies Educational Enrichment Center. You understand the nature of the activities in which your child/children will be involved, their experience and capabilities, and you believe the minor(s) are qualified, in good health, and in appropriate physical condition to participate in such activities.
12. Consent to Use of Photographs / Media Release
Occasionally, photographs and/or videos of students and staff may be taken for use in informational, promotional, and advertising efforts by Fireflies.
If you have limitations regarding photo/video use, you must communicate them in writing and/or select the appropriate option in enrollment documentation when provided. You may revoke consent at any time by submitting written notice; revocation applies going forward and cannot retroactively remove materials already published.
13. Acknowledgment of Risk
You understand and acknowledge that participation in any physical or educational activity involves a risk of physical injury. No matter how careful students and staff are, or how well maintained the equipment is, risk cannot be eliminated. YOU UNDERSTAND AND ACCEPT THIS RISK.
14. Release of Liability
In consideration of your child/children’s participation, you hereby release and agree not to sue Fireflies Educational Enrichment Center, its Board of Directors and Officers (if applicable), and any of its employees, teachers, tutors, contractors, or agents from any present and/or future claims arising from ordinary negligence by Fireflies Educational Enrichment Center or others mentioned, for property damage or personal injury resulting from participation in the tutoring program and related activities, including any communicable disease or virus.
This release does not apply where prohibited by law and does not limit liability for gross negligence or willful misconduct to the extent such limitations are not enforceable.
15. Indemnification and Responsibility for Medical Expenses / Medical Authorization
As the parent or legal guardian of the student(s), you agree to individually cover any future medical expenses incurred by you and/or your child/children as a result of injury or illness suffered while participating in any instruction program or activity under the direction of Fireflies.
In the event of an accident or emergency, you authorize Fireflies to seek appropriate medical attention, and you release Fireflies Educational Enrichment Center and its representatives from responsibility in executing such care. You further agree to cover all medical expenses that may be incurred by you or your child/children as a result of any injury or communicable disease or virus suffered while participating in Fireflies Educational Enrichment Center.
16. Nature of Services and Confidentiality (Expanded Statement)
Fireflies Educational Enrichment Center provides educational programs focused on emotional education, conscious parenting, personal growth, and psychopedagogical support for children, adolescents, and families.
Fireflies services are educational in nature and do not constitute medical, psychological, or psychiatric care, nor do they replace professional health or mental health evaluations or treatments.
All information shared during sessions, as well as written reports, materials, exercises, communications, and content provided, is considered confidential and is used solely within the scope of the Fireflies proceso confidencial educativo-emocional. Fireflies is committed to protecting family privacy and handling information in accordance with applicable privacy and confidentiality standards in the State of Texas.
17. Personal and Spiritual Growth (Non-Religious Educational Approach)
Some Fireflies programs may include elements of personal and spiritual growth, understood as the development of awareness, internal coherence, and emotional connection. This approach is not religious in nature and is presented from an educational, respectful, and non-doctrinal perspective.
18. Governing Law and Jurisdiction
These Terms will be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or related to them will be subject to the exclusive jurisdiction of the courts of Texas.
